, and associated digital stores or marketplaces such as ThriveCart and Etsy) (collectively the “Template Materials”) are subject to the following terms and conditions (“Terms of Use”) and all applicable laws.
By accessing, downloading, or using any Bright Site Studio template, you accept, without limitation or qualification, these Terms of Use and acknowledge that any other agreements between you and Bright Site Studio are superseded and of no force or effect.

1. Ownership and Use of Content

You agree that the template itself, as well as all content, layouts, graphics, copy prompts, materials, training, and accompanying resources (collectively referred to as the “Content”) are maintained for your personal use and information by Bright Site Studio (the “Company”) and are the property of the Company and/or its third-party providers.
You agree that such Content includes all proprietary design files, code, graphics, copy, photos, and text, as well as all other materials included with the template, excluding only the materials you provide or customize.

Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, and non-sublicensable license to access, view, and use the template solely for your personal or business use as intended.
No Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, or used for public or commercial resale purposes without written permission from the Company.
Modification or use of the Content for any other purpose is a violation of copyright and other proprietary rights of the Company, as well as other authors who created the materials.

You may not distribute, modify, transmit, or use any portion of the template, including software, design files, or assets, for resale, licensing, or sharing without the express written permission of the Company.

2. Copyright and Intellectual Property

All Content provided within the template is copyrighted unless otherwise noted and is the property of Bright Site Studio and/or its suppliers.
No such materials may be used except as provided in these Terms of Use.

3. Trademarks and Attribution

All trade names, trademarks, and brand elements (including without limitation the name and trademark Bright Site Studio, Bright Site Templates, and Bright Site Method) are either the property of, or used with permission by, the Company.
Unauthorized use of these marks or the template content may violate copyright, trademark, and other proprietary rights laws.

Nothing contained in this Agreement shall be construed as granting any license or right to use any trademark or proprietary information without express written consent from the Company.

4. Accuracy and Disclaimer

While Bright Site Studio makes every effort to ensure the accuracy and quality of its templates, we make no guarantees as to the accuracy, completeness, or performance of the Content.
The Company assumes no liability for any errors, omissions, or outcomes resulting from the use of the template.

5. Communications

By purchasing or downloading a template from Bright Site Studio, you consent to receive communications from us including updates, notices, and product information via email.

6. User Submissions

If you send comments, feedback, or suggestions about a template (including but not limited to notes, edits, or design ideas), such submissions become the property of Bright Site Studio.
No submission shall be subject to any obligation of confidence. The Company may use such submissions for marketing, development, or other purposes without acknowledgment or compensation to you.

7. Security and Access

While Bright Site Studio uses commercially reasonable efforts to restrict unauthorized access to data and files, no system is completely secure.
You acknowledge that it may be possible for unauthorized third parties to access or distribute template files. Use of templates is at your own risk.

8. Privacy Policy

Bright Site Studio respects your privacy and will not intentionally disclose personally identifying information except where required by law or necessary to enforce these Terms.

9. Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL BRIGHT SITE STUDIO, ITS OWNERS, OR CONTRACTORS BE LIABLE FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OR INABILITY TO USE THE TEMPLATE OR RELATED MATERIALS.
ALL CONTENT IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED.
The Company does not warrant that use of the template will be uninterrupted or error-free or that any defects will be corrected.
You assume full responsibility for your use and any necessary maintenance, repairs, or corrections.

10. Third-Party Services

The Company shall not be responsible for issues caused by third-party software or platforms (including Kajabi, Showit, ThriveCart, Canva, or others).
Any such problem shall be governed solely by the agreement between you and that provider.

11. Refunds and Termination

Due to the digital nature of our templates, all sales are final.
The Company reserves the right to revoke access or terminate your license if it determines you have violated these Terms.

12. Indemnification

You agree to indemnify and hold harmless Bright Site Studio, its directors, and affiliates from any and all claims or damages arising out of your breach of these Terms or misuse of the template.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, and any disputes shall be resolved in the courts of Sydney, NSW.

14. Revisions

These Terms of Use may be updated from time to time.
By continuing to use any template after such changes, you agree to be bound by the revised version.
